Terms and Conditions for Real Estate Photography Services

1. Introduction
Welcome to Kaplan Visual. By booking our photography services, you agree to be bound by the following terms and conditions. Please read these terms carefully before using our services.

2. Services
We offer professional real estate photography services, including but not limited to interior and exterior photography, aerial photography, virtual tours, website creation, and photo/video editing (collectively, the "Services").

3. Booking and Payment
3.1 Booking
Clients can book our services through our website KaplanVisual.com, by phone, by text, or by email. Bookings are subject to availability, and we reserve the right to refuse any booking request at our discretion.
3.2 Payment
Payment total is confirmed upon booking and is due prior to delivery of Services. We accept credit cards, Venmo, and Zelle. If paying by personal check, please provide it at the photo shoot.
3.3 Cancellation and Rescheduling
Cancellations made less than 12 hours of scheduled session will be charged a $200 cancellation fee - this can be paid on the invoice for a rescheduled appointment within 1 month of the original canceled appointment.

4. Client Responsibilities
4.1 Property Preparation & Client Responsibility
Clients are responsible for ensuring that the property is clean, tidy, and ready for photography. We recommend removing personal items, decluttering, and ensuring all areas to be photographed are accessible. The photographer will only be available for the allotted amount of time indicated in the initial scheduling confirmation. The Client shall assist and cooperate with the Photographer in obtaining the desired photographs, including but not limited to: specifying locations to be photographed, and taking time to prepare the locations to be photographed. The Photographer shall not be responsible for photographs not taken as a result of the Client’s failure to provide reasonable assistance or cooperation. In the absence of prior instruction or request, the individual photographs recorded and provided will be at the Photographer's discretion. The Client is responsible for ensuring the selected package suits their needs and the property. The Photographer is not responsible if the chosen package does not provide adequate photographic coverage of a property. Details on pricing and packages is available at: KaplanVisual.com. Additional on-site time is not guaranteed, and will be billed at a rate of $25.00 per 15 mins. Additional retouching and post-processing can be performed at a rate $10-$30 per image.
4.2 Access to Property
Clients must provide access to the property at the agreed-upon time. If access is not provided, the $200 late cancelation fee will apply.

5. Delivery of Photographs
5.1 Delivery Time
We will deliver the final edited photographs within 48 hours after the photography session. Delivery times for other services may vary depending on the scope of the project.
5.2 Delivery Method
Media will be delivered via online gallery. Clients will receive a link to download the high-resolution images/video/etc.

6. Copyright and Usage
6.1 Copyright
All photographs taken by Kaplan Visual are the intellectual property of Kaplan Visual. We retain full copyright to all images.
6.2 Usage Rights
Clients are granted a non-exclusive, non-transferable license to use the photographs for marketing and promotional purposes related to the sale or rental of the property. The photographs may not be altered, sold, or used for any other purpose without prior written consent from Kaplan Visual. Other use, including but not limited to: marketing material for a real estate agent (business cards, web site banners, etc.), builder, architect, designer, stager, etc. is prohibited without first consulting the Photographer.

7. Liability
7.1 Limitation of Liability
To the fullest extent permitted by law, Kaplan Visual shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, revenue, or data, arising out of or in connection with our services.
7.2 Force Majeure
We are not liable for any failure or delay in performing our obligations under these terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, or any other unforeseen events.

8. Amendments
We reserve the right to amend these terms and conditions at any time without prior notice. Any changes will be posted on our website, and it is the client's responsibility to review these terms regularly.
